Like all Management Liability Insurance products, the AXA Management Liability Policy protects company directors, senior managers and officers of charities, boards and committees if a negligence claim is brought against them in court or at an employment tribunal.

There are three main areas of cover

Directors’ & Officers’ Liability
This section of cover protects the personal wealth of you, the director and any other management staff from the legal costs and awards in defending against civil, criminal and regulatory claims or investigations.

Employment Practices Liability
This covers both you, the directors and the business from claims from potential, current and former employees alleging breach of contract/employment law.

Corporate Legal Liability
Claims can be made against the directors and officers and also the business itself in tandem. This cover protects the legal entity (business) from defence costs incurred relating to civil, and regulatory claim or investigations.

How much does it cost?

AXA Management Liability Policy premiums are competitive, starting with £100,000 of cover (for any one claim) across the 3 areas of cover for £14 per month∗. When you add in the services offered by rradar, this is a policy that offers value for money.

Claim type: Unfair dismissal

Background

An IT consultancy faced a claim from a former employee who had been made redundant. The employee claimed he shouldn’t have been selected for redundancy as he had taken a salary sacrifice in the last year.

How did the policy respond?

The Employment Practice Liability section provides cover for a wide range of employment matters such as unfair dismissal, breach of contract and discrimination. This claim could be covered for defence costs up to the selected limit of liability under this section.

Claim type: Jurisidcation issues – Scotland

Background

One of the Directors of the insured was driving during the course of business when he was pulled over by police and charged with using a mobile phone while driving. The Director contacted rradar for advice and made a claim when a court citation arrived. The Director was facing 6 penalty points if convicted of the offence, which would have resulted in a ban from driving under the totting-up provisions of the Road Traffic Offenders Act 1988.

Claim type: Pension investment error

Background

A recently retired employee made a claim against his former employer. He alleged the company had failed to amend his investment risk profile as he had asked, leading to a loss of £15,000 from his pension pot. It was clear that an error had indeed been made and the company was required to settle the claim.
